3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials

• One person or entity may not maintain multiple accounts

Account Responsibilities

• You are solely responsible for all activities that occur under your account
• You must not share your account credentials with others
• You must not use another user's account without permission
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Intellectual Property Rights

Your Content

• You retain all ownership rights to music, images, videos, and other content you upload
• By uploading content, you grant VibeMV a limited license to process, store, and display your content solely for the purpose of providing our services
• You represent and warrant that you have all necessary rights to the content you upload
• You are responsible for ensuring your content does not infringe on others' intellectual property rights

Generated Videos

• You own the music videos generated by VibeMV using your content and prompts
• VibeMV retains no ownership rights to your generated videos
• You may use, modify, distribute, and commercialize your generated videos freely
• Attribution to VibeMV is appreciated but not required

Platform Content

• VibeMV's platform, software, AI models, features, and functionality are protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, sell, or lease any part of our services
• You may not reverse engineer or attempt to extract source code from our platform

5. Acceptable Use Policy

You agree NOT to use VibeMV to:

Prohibited Content

• Create videos containing illegal, harmful, or offensive content
• Infringe on copyrights, trademarks, or other intellectual property rights
• Generate content depicting violence, hate speech, or harassment
• Create deepfakes or misleading content without proper disclosure
• Produce sexually explicit, adult, nude, or NSFW content
• Violate any person's privacy or publicity rights

Prohibited Activities

• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Use automated systems (bots, scrapers) without authorization
• Resell, sublicense, or exploit our services for commercial purposes without permission
• Upload malware, viruses, or malicious code
• Engage in any activity that could harm VibeMV or its users

6. Subscription and Payments

Subscription Plans

• VibeMV offers free and paid subscription tiers with different features and usage limits
• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or as expressly stated

Billing

• You authorize us to charge your payment method for all fees incurred
• You must maintain valid payment information for paid subscriptions
• Price changes will be notified in advance and apply to subsequent billing cycles

Cancellation

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to paid features until the end of your billing period

7. Usage Limits and Fair Use

Resource Limits

• Excessive or abusive use may result in temporary suspension or termination

Content Moderation

VibeMV does not support NSFW, adult, nude, or sexually explicit content. We use content moderation to enforce this policy across user inputs and generated content.

• We may review generated content to ensure compliance with these Terms
• We may use automated content safety filters on prompts, uploaded/reference images, and generated outputs
• Requests blocked by our content policy may be rejected before generation begins
• We reserve the right to remove content that violates our policies
• Repeat violations may result in account suspension or termination

8. AI-Generated Content Disclaimer

AI Limitations

• AI-generated videos are created using machine learning models and may not always meet your expectations
• We do not guarantee the accuracy, quality, or suitability of generated content
• Results may vary based on input quality, prompts, and other factors

No Warranty

• AI-generated content is provided "as is" without warranties of any kind
• You are responsible for reviewing and verifying generated content before use
• We are not liable for any issues arising from the use of AI-generated videos

9. Data Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information and creative content.

10. Service Availability

• VibeMV is provided on an "as is" and "as available" basis
• We do not guarantee uninterrupted, secure, or error-free service

11. Limitation of Liability

To the maximum extent permitted by law:

• VibeMV shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not responsible for any loss of data, revenue, profits, or business opportunities
• We are not liable for content created by users or generated by AI models

12. Indemnification

You agree to indemnify and hold harmless VibeMV, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your infringement of any intellectual property or other rights
• Your use of the service or generated content
• Your uploaded content

13. Copyright Infringement

We respect intellectual property rights. If you believe your copyright has been infringed:

• Include the copyrighted work and the allegedly infringing material
• Provide your contact information and a statement of good faith belief

We will investigate and take appropriate action, which may include removing content or terminating accounts.

14. Termination

• Termination does not relieve you of any obligations for fees incurred

By Us

We may suspend or terminate your account if:

• Your account remains inactive for an extended period
• We discontinue the service
• Required by law or regulatory authority

Effect of Termination

• You will lose access to your account and generated content
• We may delete your data in accordance with our data retention policy
• Provisions that should survive termination will remain in effect

15. Changes to Terms

• Continued use after changes constitutes acceptance of modified Terms
• If you disagree with changes, you must stop using VibeMV

16. Dispute Resolution

Arbitration

• Disputes shall be resolved through binding arbitration

17. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and VibeMV.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
